These Terms govern your use of the RingBack AI service (the “Service”) provided by RingBack AI (“RingBack,” “we,” “us”). By purchasing or using the Service you agree to these Terms and to our Privacy Policy.
1. Service
RingBack provides an AI receptionist for your business: answering and routing your calls and texts, generating AI conversation responses, booking appointments, missed-call text-back and automated follow-ups, and a dashboard of your calls, messages, contacts, and calendar. Features depend on the plan you purchase. Telephony is delivered through third-party carriers and providers, whose availability we do not control.
2. Fees & billing
Setup fees are one-time and non-refundable except as stated in the Guarantee. Monthly fees are billed in advance via our payment processor (Stripe) and recur until cancelled. You authorize recurring charges to your payment method. Your own third-party costs (for example a Twilio account you connect, or carrier messaging-registration fees) are yours.
3. Guarantee
If RingBack isn’t texting back and booking from your missed calls within your first 30 days, your second month is free.
4. Cancellation
You may cancel any time from your billing settings; cancellation takes effect at the end of the current billing cycle and you will not be charged again. No partial-month refunds unless required by law.
5. Your responsibilities
You are responsible for: (a) the accuracy of your business information, pricing, and hours; (b) having a lawful basis to contact individuals who call your business; (c) the conduct of your business and any services you provide to customers booked through the Service. The Service assists with scheduling and communication; it does not provide professional, emergency, or safety services.
6. AI, recording & accuracy
AI responses are generated automatically and can be wrong, incomplete, or out of date; they are not legal, medical, financial, or other professional advice, and you are responsible for reviewing bookings and important information the AI captures. Calls answered by the AI may be recorded and transcribed. The AI receptionist discloses AI use and recording at the start of a call by default; if you customize or disable that disclosure, you are responsible for meeting any notice and consent requirements that apply where you and your callers are located.
7. Health information
The Service is not intended for protected health information (PHI) and may not be used to collect or process PHI unless we have entered into an express written agreement covering it. Certain healthcare industry configurations are unavailable until such an agreement is in place.
8. No emergency reliance
The Service is not an emergency service and must not be relied on for emergencies. Callers with safety emergencies are instructed to contact 911 or the appropriate authority. You agree the Service is not a substitute for emergency response.
9. Messaging compliance & consent
You represent and warrant that you have a lawful basis to send, and to authorize RingBack to send on your behalf, calls and text messages to each individual contacted through the Service, and that you will comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM, state messaging laws, and carrier requirements. RingBack provides compliance tooling as features — automatic STOP/opt-out handling, opt-out language on the first automated message, and AI disclosure — but you remain responsible for the lawfulness of your contact lists and the consent of the individuals you communicate with. You will indemnify and hold RingBack harmless from any claim arising from messages sent on your behalf or based on contacts you authorized.
10. Disclaimers & limitation of liability
The Service is provided “as is.” To the maximum extent permitted by law, RingBack AI’s total liability is limited to the fees you paid in the 3 months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost business or missed appointments.
11. Indemnification
You agree to indemnify RingBack AI against claims arising from your business operations, your customer communications, or your breach of these Terms (including messaging-law claims based on contacts you authorized).
12. Governing law
These Terms are governed by the laws of the State of Texas. Disputes will be resolved in the courts of Harris County, Texas.
